Obligation to record worker entries and exits

Since May 12th, it has become mandatory for the Labor Inspection to have a record of workers’ clock-in and clock-out times. The classic time clock to comply with current regulations.

Since its approval, 2 months ago, there has been contradictory information, changes of opinion, and above all a great deal of confusion even among those of us who have been dedicated to this for almost 20 years. We are going to try to shed some light on what seems to be clear:

Who is required to clock in?

All employees, except those in SENIOR MANAGEMENT and SELF-EMPLOYED WORKERS. This means that factory workers, installation technicians, middle managers, sales staff, etc. must clock in, whether they are working inside the workplace, making client visits, making deliveries, and even those who work from home for all or part of their working day. EVERYONE.

Is there a 2-month period to adapt?

Yes, there already has been. It was approved on March 12th and the adaptation period expired on May 12th, 2019. There has been information stating that they had given an additional 2 months, but that referred to the previous ones. What they have said in this last week is that penalties would not be imposed from day one, but that companies would first be warned (in fact, we have received information that they are already enforcing it), unless there is evidence of fraud. The Ministry of Labor and Industry has also reported that they would give a reasonable period to companies that can prove they are negotiating with workers the implementation of the system. If a record of workers’ working hours is not available, the fine can reach €6,250. Our systems are much more affordable.

What systems are valid?

The regulation states that it must be a system that cannot be tampered with or falsified, and that it must be available to workers or the Labor Inspection immediately for 4 years. This record must be accessible at the same workplace, not being allowed to be stored at the central offices to avoid possible manipulation in the interval between the request and delivery.

I don’t have any control system. What should I do?
