Obligation to register employee entries and exits

Since May 12th, it has become mandatory by the Labor Inspection to have a record of the entries and exits of workers. The classic time clock for compliance with current regulations.

Since its approval, two months ago, there have been contradictory information, changes of opinion, and above all, a lot of confusion even among those of us who have been dedicated to this for almost 20 years. We will try to shed some light on what seems to be clear:

Who is required to clock in?

All employees, except for SENIOR MANAGEMENT and SELF-EMPLOYED individuals. This means that factory workers, installation technicians, middle management, salespeople, etc., must clock in whether they are working inside the workplace, visiting clients, making deliveries, or even those who work from home for all or part of the day. EVERYONE.

Is there a 2-month period to adapt?

Yes, there has already been one. It was approved on March 12 and the adaptation period ended on May 12, 2019. There have been reports stating that they granted 2 more months, but they were referring to the previous ones. What has been said in this last week is that there will be no penalties from the first day, but companies will be warned (in fact, we have received information that they are already demanding it), unless there is evidence of fraud. It has also been reported by the Ministry of Labor and Industry that they would give a reasonable period to companies that prove they are negotiating with workers for the implementation of the system. In case there is no record of the working hours of the employees, the penalty can reach €6,250. Our systems are much more economical.

What systems are valid?

The regulation states that it must be a system that cannot be manipulated nor falsified, and that is available to workers or the Labor Inspection immediately for 4 years. This record must be accessible at the same workplace, and it is not allowed to be stored at the headquarters to prevent possible manipulation during the interval between the request and delivery.

I don’t have any access control system. What should I do?
