Royal Decree Law 8/2019 establishes the criteria for the time registration of workers in Spain. This regulation arises to address compliance with working hours and to prevent fraud related to unaccounted or unpaid overtime. According to this regulation, companies are required to:

  • Initiate a record of the start and end times of the workday for all workers.
  • Keep this information for four years.
  • Make this information available to workers, their representatives, and labor inspectors.

Measures to Avoid Penalties

Possible Penalties for Non-Compliance

The failure to comply with time registration can result in economic penalties. Violations can be classified as:

  • Minor Violations: Fines ranging from 60 to 625 euros. These occur when the company does not adequately inform its workers or does not provide time records.
  • Serious Violations: Fines ranging from 625 to 6,250 euros. These occur when there are irregularities in time registration or when overtime hours worked are not compensated.
  • Very Serious Violations: Fines that can reach up to 187,515 euros. These occur when the annual permitted overtime hours are exceeded or when they are not paid.

Initial Examples of Penalties

Since the implementation of the time control law, inspections have been carried out in companies to verify compliance. During the first months, 5,363 cases were recorded due to non-compliance, with an average fine of 105,776 euros. In total, more than 980 companies received penalties, amounting to a total of 113,000 euros in fines for time control.
